Chalos & Co, P.C., Featured in Maritime Executive Magazine Maritime Matrix Today
The Maritime Matrix Today published a feature story on Chalos& Co and the case of United States of America v. Fafalios, 15-30146. Matthaios Fafalios was a Chief Engineer of a foreign flagged vessel detained in New Orleans in connection with a MARPOL investigation. Mr. Fafalios was wrongly charged and convicted for purportedly "failing to maintain an oil record book aboard a foreign-flagged merchant vessel." On appeal, the Fifth Circuit agreed with the defendant Chief Engineer and overturned conviction; holding that the trial court should have followed the unambiguous language of the statute in question, which provides that the "master or other person having charge of the ship" has the legal obligation and responsibility for maintaining the oil record book.
